Blanco v. Baxter Healthcare Corp.
California Court of Appeal
70 Cal. Rptr. 3d 566 (2008)
- Written by Douglas Halasz, JD
Facts
Claudia Blanco (Claudia) was diagnosed with a heart condition concerning her mitral valve. A few months later, a wholly owned subsidiary of Baxter-Travenol Laboratories, Inc. (Baxter) (defendant) purchased a company that developed prosthetic mitral valves. Claudia underwent an unsuccessful surgery to repair her mitral valve. Accordingly, the surgeons replaced Claudia’s natural mitral valve with one of Baxter’s prosthetic valves. Approximately 15 years later, Claudia died from a problem with the prosthetic valve. Michael and Jonathon Blanco (collectively, Blanco) (plaintiff) sued Baxter for, among other things, breach of implied warranties.
