Facts
James Andrich (defendant) was throwing rocks at a sign in a restaurant parking lot when Thomas Blazovic (plaintiff) approached. It was disputed whether Blazovic approached politely or aggressively, but it was undisputed that Andrich initiated a physical confrontation with Blazovic. Blazovic sued Andrich for damages. After trial, the jury found Andrich had committed an intentional assault and battery against Blazovic; however, the jury imposed a percentage of liability on Blazovic under the principle of comparative negligence, finding that Blazovic’s own negligent conduct had contributed to his injuries. Blazovic appealed.
