Facts
Ronald Bloomberg’s (plaintiff) son was riding as a passenger in a car with a friend at night. While the car was on the highway, it began to break down. The friend pulled the car over to the side of the road and called the highway patrol for help. The highway patrol connected the friend to a tow-truck company, Interinsurance Exchange (defendant) and a tow truck was dispatched. The tow-truck driver could not find the car. About one hour after the tow truck was dispatched, a drunk driver crashed into the car. The injuries that Bloomberg’s son suffered resulted in his death. Bloomberg brought suit. The trial court found in favor of Interinsurance Exchange. Bloomberg appealed.
