Facts
BN (plaintiff) worked as a nurse at a hospital, where she met KK (Dr. K) (defendant). BN and Dr. K began to date and engage in sexual intercourse. At the time of the relationship, Dr. K had genital herpes and did not disclose this to BN. Dr. K also did not disclose when his disease was active and likely to pass on to BN during intercourse. As a result, BN was diagnosed with genital herpes. BN brought a fraud claim against Dr. K. Dr. K argued that he did not have a duty to disclose because the parties did not have a confidential relationship. The trial court found in favor of Dr. K. BN appealed.
