Facts
VetPlus Ltd. (defendant) sold a dietary supplement for dogs called Synoquin. Boehringer Ingelheim Ltd. (Boehringer) (plaintiff) sold Seraquin, another, similar dietary supplement for dogs. VetPlus decided to test Boehringer’s product to see whether it contained the precise amounts of ingredients that Boehringer advertised. VetPlus found that it did not and sought to make advertisements stating so. In opposition, Boehringer sought an injunction against VetPlus preventing it from making those advertisements, on the grounds that the advertisements would violate Boehringer’s rights to its trademarks.
