Boeynaems v. LA Fitness International
United States District Court for the Eastern District of Pennsylvania
285 F.R.D. 331 (2012)
- Written by Rich Walter, JD
Facts
A large and successful law firm represented Elisabeth Boeynaems and four other consumers (plaintiffs) who sued LA Fitness International, LLC (defendant) in federal court, alleging that LA Fitness engaged in deceptive practices designed to keep the consumers from terminating their memberships in LA Fitness’s gym clubs. The consumers requested extensive pretrial discovery. LA Fitness conducted this discovery at its own expense but produced very little evidence that supported the consumers’ motion to certify the case as a class action. The consumers moved to reopen discovery. LA Fitness responded that any additional pretrial discovery should come at the consumers’ expense.
