Facts
Bobbye Bonds (plaintiff) was the lessor under an oil and gas lease to which the Sanchez-O’Brien Oil and Gas Company (Sanchez) (defendant) was the lessee. When production ceased, Sanchez plugged and abandoned the well. However, Sanchez left water pits, concrete, and dams on the surface of the land when leaving the leasehold for the final time. Bonds brought suit against Sanchez, arguing that Sanchez had an implied duty to remove the debris and restore the surface. The trial court ruled in favor of Sanchez. Bonds appealed.
