Facts
Sharon Bonte (defendant) was seven months pregnant when she crossed the street and was hit by a car. Sharon’s baby, Stephanie Bonte, was born shortly after the accident with catastrophic brain damage and cerebral palsy. Stephanie’s father, Andre Bonte (plaintiff), filed suit against Sharon individually and as Stephanie’s next friend, alleging that Sharon was negligent in crossing the street and failing to use a crosswalk. The trial court dismissed Andre’s complaint, and Andre appealed.
