Facts
Juanita Boone (plaintiff) was injured when the car driven by her husband Freddie (defendant) was involved in an accident in Georgia. The Boones were residents of South Carolina. Juanita filed suit in South Carolina against Freddie seeking damages. The trial court concluded that Georgia law applied to the facts of the case and dismissed Juanita’s complaint based on a Georgia law that provided for interspousal immunity in personal injury actions. Juanita appealed. The Supreme Court of South Carolina granted certiorari to determine whether Georgia’s interspousal immunity law violated the public policy of South Carolina.
