Facts
Former school principal Lionel Bordelon (plaintiff) brought a discrimination lawsuit against the Board of Education of the City of Chicago (defendant), claiming it did not renew his contract because of his age. Bordelon tried to submit the affidavit of the president of the Chicago Principals and Administrators Association, Clarice Berry. Berry said that other, older principals had told him that Bordelon’s supervisor gave their schools less support than schools with younger principals. The trial court excluded Berry’s statements as hearsay and granted summary judgment for the school board. Bordelon appealed.
