Borse v. Piece Goods Shop
United States Court of Appeals for the Third Circuit
963 F.2d 611 (1992)
- Written by Sean Carroll, JD
Facts
Sarah Borse (plaintiff) worked as an at-will employee for Piece Goods Shop, Inc. (Piece Goods) (defendant). Pursuant to Piece Goods policy, the company asked Borse to take a drug test and submit to personal-property searches. When Borse refused, Piece Goods terminated her employment. Borse sued Piece Goods for wrongful discharge, claiming that the termination related to an invasion of her personal privacy and thus violated public policy. The United States District Court for the Eastern District of Pennsylvania granted Piece Goods’ motion to dismiss for failure to state a claim. Borse appealed.
