Boston Celtics v. Brian Shaw
United States Court of Appeals for the First Circuit
908 F.2d 1041 (1990)
- Written by Craig Conway, LLM
Facts
Brian Shaw (defendant) was a professional basketball player who signed a contract to play for the Boston Celtics (plaintiff). As part of the contract, Shaw agreed to cancel his contract with Italian basketball team, Il Messaggero Roma. However, Shaw later decided that he wanted to play for the Italian team and an arbitrator found for the Celtics. Subsequently, the Celtics brought suit for an injunction to enforce the arbitrator’s award and requiring Shaw to terminate his contract with Il Messaggero Roma and prohibiting Shaw from playing for any other team other than the Celtics. The district court granted the injunction and Shaw appealed.
