Facts
Earl Bothwell (plaintiff) filed suit against Republic Tobacco Company (Republic) (defendant), alleging that he had been harmed by Republic’s tobacco products. Bothwell was indigent and filed a motion requesting the appointment of counsel. The judge issued an order to an attorney, Paula Metcalf, appointing her as Bothwell’s counsel. Metcalf filed a motion to vacate the order, asserting that federal courts have no authority to compel an attorney to provide counsel in a civil case to an indigent party without compensation.
