Facts
A store, F.W. Woolworth & Co., LTD. (Woolworth) (defendant), sold copies of an American detective magazine, one issue of which contained a story titled “Swindlers and Scoundrels. Horatio Bottomley, Editor & Embezzler.” Bottomley (plaintiff) brought suit for libel. The jury found that Woolworth was negligent in failing to periodically examine sample magazines for potentially libelous content, but the court found in favor of Woolworth. Bottomley appealed. The case came before the Court of Appeal.
