Facts
During surgery at Dixie Medical Center (Dixie) (defendant) to fix an injured hand, 18-year-old Daniel Boucher (plaintiff) lapsed into a coma. Daniel awoke from the coma 10 days later but by that point was a brain-damaged quadriplegic who would require substantial lifelong care. In addition to bringing a claim against Dixie on Daniel’s behalf, Daniel’s parents, James and Torla Boucher (the Bouchers) (plaintiffs) also filed claims on their own behalf, one of which sought damages for the loss of their child’s consortium. The trial court dismissed the loss-of-consortium claim. The Bouchers appealed to the Utah Supreme Court.
