Facts
An agent from Spiegel, Inc. (defendant) called Pearl Bowden (plaintiff) regarding an unpaid bill she owed to Spiegel. The agent threatened to sue Bowden if she did not pay the bill immediately. Although Bowden did not owe any money to Spiegel, the phone call greatly upset her and caused her to become physically ill from distress. Bowden sued Spiegel for intentional infliction of emotional distress, and Spiegel filed a demurrer. The trial court sustained Spiegel’s demurrer and dismissed Bowden’s case. She appealed.
