Facts
Bower (plaintiff) sued Weisman (defendant) for breaching several parts of an agreement the two made prior to ending their personal and business relationship. Weisman made a motion for a more definite statement and moved to dismiss the charge of fraud for failure to state fraud with particularity. Weisman also made a motion to dismiss for failure to state a claim upon which relief can be granted for each of Bower’s claims for trespass, false imprisonment, intentional infliction of emotional distress, and private nuisance.
