Facts
Prison officials at the prison in which Boyd (plaintiff) was imprisoned instituted a temporary ban on all publications featuring women in sexy poses. Boyd sued Venetia Michael (defendant), a prison official, alleging that the ban violated his First Amendment rights. Other inmates testified in depositions that they had been denied access to magazines. The other inmates also described conversations among the general inmate population regarding magazine bans. Michael filed a motion in limine seeking to exclude the other inmates’ testimony at trial.
