Facts
Lawrence Fox (defendant) and Matilda Fox were married in 1949. In 1950, Lawrence and Matilda purchased a property in joint tenancy. Lawrence murdered Matilda in 1954. Three days later, Lawrence conveyed the property to his attorney. Matilda’s daughter and the administrator of Matilda’s estate (plaintiffs) sued to impose a constructive trust on the property. The trial court granted Lawrence’s motion to dismiss, and the plaintiffs appealed.
