Facts
Bradley (plaintiff) and 177 other physicians sued to enjoin the Food and Drug Administration (FDA) from forcing manufacturers to comply with the FDA’s requirement that manufacturers alter the labels on certain diabetes drugs. The FDA wanted the manufacturers to alter the drug labels to include a special warning regarding adverse heart effects. Bradley argued that the labels should also include statements regarding problems with the studies finding the adverse heart effects. The district court granted a preliminary injunction, which was appealed to the United States Court of Appeals for the First Circuit.
