Bray v. Bi-State Development Corporation
Missouri Court of Appeals
949 S.W.2d 93 (1997)
- Written by Sean Carroll, JD
Facts
Rosemary Bray (plaintiff) broke her shoulder, arm, and kneecap when she fell in a parking garage operated by Bi-State Development Corporation (BSDC) (defendant). Bray brought a personal-injury lawsuit against BSDC. At trial, BSDC introduced, over Bray’s objection, a computer-generated chart that showed the lighting levels in the parking garage at the time of Bray’s fall. The chart was the product of several computations performed by a computer. An expert witness testified that the computer program produced accurate results, and also thoroughly explained the relevant variables and results. The jury found in favor of BSDC. Bray appealed, arguing that BSDC did not lay a proper foundation for the computer-generated chart prior to introducing it into evidence.
