Facts
BreathableBaby LLC (plaintiff) brought a federal patent-infringement lawsuit against Crown Crafts, Inc. (defendant). The court’s discovery order incorporated the parties’ agreement that Crown Crafts would conduct a keyword search to produce relevant and discoverable electronically stored information (ESI). Crown Crafts subsequently proposed that, instead of using search terms, Crown Crafts would review all of its employees’ ESI files for relevant discoverable material. BreathableBaby agreed to this proposal. In fact, however, Crown Crafts reviewed the ESI of only a select group of employees thought most likely to possess relevant material. Of that select group’s files, Crown Crafts searched only those files the titles of which made their relevance to the litigation obvious. BreathableBaby was dissatisfied with the results of Crown Crafts’ modified search and moved to compel discovery according to the court’s discovery order.
