Facts
Henry Biber (defendant) and John Brennan were in a car accident. John’s three infant children were in his car. One of the children required medical care after the wreck. Monica, John’s wife, arranged for the medical care, but John paid for it. John, Monica, and their three children (plaintiffs) sued Biber for damages related to injuries to John and the three children. Monica also made a claim for loss of the children’s services, society, and companionship. Biber asserted contributory negligence as one of several defenses, and the jury found that John was contributorily negligent. The jury found in favor of one of the children but against John, Monica, and the other two children, and the Brennan family subsequently filed a motion for a new trial.
