Facts
Briefing.com (plaintiff) was a company that provided investment analyses for use by investors. Gregory Jones and Cynthia Dietzmann (defendants) were former employees of Briefing.com who worked in the Wyoming office of Briefing.com and left Briefing.com to form a competing business, StreetAccount L.L.C., a Wyoming company. Briefing.com and its president, Richard Green (plaintiff) (collectively, Briefing.com), sued Jones and Dietzmann for misappropriation of trade secrets or confidential information. Briefing.com alleged that Jones and Dietzmann had access to Briefing.com’s confidential information and that Dietzmann created market-contact information that belonged to Briefing.com, which Dietzmann took with her when she left the company. Jones and Dietzmann moved to dismiss the complaint, arguing that Wyoming law did not recognize a cause of action for misappropriation of trade secrets. The trial court certified the question of whether Wyoming law recognized a cause of action for misappropriation of trade secrets to the Wyoming Supreme Court.
