Facts
Brooker (plaintiff), a telephone-exchange operator, was called by Silverthorne (defendant) who requested a particular connection. When Brooker was unable to establish the connection, he berated her with abusive language and told her, “If I were there, I would break your God damned neck.” Brooker sued Silverthorne in a South Carolina court, alleging that his harsh and threatening language caused her great mental suffering and fear. Silverthorne denied Brooker’s allegations. A verdict was rendered in favor of Brooker. Silverthorne appealed.
