Facts
A group of 14 mortgagors led by named-plaintiff Brown (plaintiffs), sought plaintiff class certification against numerous lending institutions (defendants) for violating state and federal antitrust laws by allegedly conspiring to reduce market competition by eliminating a method of accounting for mortgage escrow payments. The district court initially denied certification under Federal Rule of Civil Procedure 23(b)(2). Brown alternatively sought class certification under Rule 23(b)(3).
