Facts
A 15-year-old boy named Thomas Brown (plaintiff) and two other boys trespassed on the property of Jesus Martinez (defendant) to steal Martinez’s watermelons. Martinez fired his rifle intending to scare off the boys, but he unintentionally shot and injured Brown. Brown brought suit. The trial court dismissed the complaint. Brown appealed.
