Facts
Two unions, Local 144 (union 1) and Local 1115 (union 2) (plaintiff), were competing to become the exclusive collective-bargaining representative for the 125 employees of Bruckner Nursing Home (Bruckner) (defendant). At one point, union 1 notified Bruckner that it had obtained signed authorization cards from a majority of the employees. Thereafter, union 2 notified Bruckner that it was seeking to represent the employees and initiated an action against Bruckner before the National Labor Relations Board (the board). A neutral card count revealed that union 1 had the support of most of Bruckner’s employees—approximately 80 or 90 percent. Union 2 had obtained two authorization cards at that point. Bruckner, which had initially delayed its negotiations with union 1 due to union 2’s claim, now commenced negotiations with union 1. At no point did either union file a representation petition. The board was called on to decide whether Bruckner had unlawfully assisted union 1.
