Facts
A group of married women (the wives) (plaintiffs) who were victims of domestic violence brought suit against the New York City Police Department (the department) (defendant). The wives’ complaint alleged that there were many instances in which police officers from the department declined to arrest husbands who physically assaulted their wives solely because the victims were married to their assailants. The department filed a motion for summary judgment. The trial court took the motion under advisement.
