Facts
New York City, led by mayor Ed Koch (defendant), decided to close one of its 17 municipal hospitals. The city hoped the closing would save reduce costs and improve the efficiency of its hospital system. The city’s task force found that the hospital at issue had high operating deficits, obsolete plants, and was located within 30 minutes of other municipal hospitals with similar or broader services. The hospital also served a population that was 98-percent minority. The plaintiffs argued that although the hospital was an appropriate choice for closing, the closing violated federal civil rights statutes. The trial court denied the plaintiffs’ request for a preliminary injunction. The United States Court of Appeals for the Second Circuit heard the appeal.
