Facts
Christy Brzonkala (plaintiff) was a student at Virginia Polytechnic Institute (Virginia Tech) (defendant). Brzonkala was raped by Antonio Morrison, a fellow student at Virginia Tech. Brzonkala filed a complaint against Morrison with Virginia Tech. Virginia Tech sentenced Morrison to a one-year suspension, but after Morrison appealed through Virginia Tech’s administrative system, his punishment was set aside. Subsequently, Brzonkala brought suit, contending that Virginia Tech violated Title IX of the Education Amendments of 1972 (Title IX). The district court dismissed the case. Brzonkala appealed.
