Facts
Lester Buchanan (plaintiff) sued American Motors Corporation (American) (defendant) for an alleged defect in a car that American manufactured. American issued a subpoena to Richard Snyder, an expert who had written a report on the safety of American’s product. The subpoena directed Snyder to appear and bring “any and all research data, memoranda, correspondence, lab notes, reports, calculations . . . and the like” pertaining to his study. Snyder was not otherwise involved in the litigation, but American expected that Buchanan would use Snyder’s report at trial. The district court quashed the subpoena. American appealed.
