Facts
W. Jack Buckamier (plaintiff) initiated a claim before the Iran-United States Claims Tribunal (tribunal), alleging that Bank Mellat (bank) (defendant) failed to transfer his funds to the United States. The bank claimed that it could not transfer Buckamier’s funds because Buckamier did not have evidence of any bank deposit. When initiating his claims, Buckamier said that he would produce evidence of the deposit through oral testimony at the hearing. Buckamier subsequently submitted an affidavit saying that his records of the bank deposit were seized when he fled Iran in response to revolutionary unrest.
