Facts
Bickerstaff (plaintiff) rented a safe-deposit box from Buena Vista Loan & Savings Bank (bank) (defendant). When $9,400 went missing from Bickerstaff’s box, he sued the bank for breach of a bailor-bailee relationship. Bickerstaff argued that the bank had failed to exercise the required ordinary care by allowing lax security standards regarding access to the safe-deposit boxes. The bank moved for summary judgment, which the trial court refused to grant. The bank appealed.
