Facts
The German government (plaintiff) decided not to grant refugee status to two Kurdish men, B and D (defendants), who were citizens of Turkey. The men had been members of an organization, the Kurdistan Workers’ Party, that was on the official list of the European Union (EU) of terrorist organizations. A court in Germany sought an initial holding from the EU Court of Justice regarding whether exclusion from refugee status was proper on the grounds of serious reasons to believe that the men had engaged in serious nonpolitical crimes or conduct at odds with the precepts of the United Nations.
