Facts
Carl Thielemann (defendant) induced Charles Burgdorfer (plaintiff) to buy land by telling Burgdorfer that Thielemann would pay a $500 mortgage on the land. Thielemann did not pay the mortgage and in fact had never intended to. Burgdorfer brought suit and the trial court found in his favor. Thielemann appealed.
