Facts
Sarah Burgess (plaintiff) took her dog, Murphy, to be groomed at Shampooch Pet Industries, Inc. (defendant). The dog was injured while at Shampooch’s facility, and Burgess took the dog to the veterinarian. The dog required surgery to repair a dislocated hip, x-rays, blood work-up, anesthesia, intravenous fluids, sutures, and pain medications. Burgess paid approximately $1,300 to the veterinarian for these services. Burgess then sued Shampooch, alleging negligence. The trial court ruled in favor of Burgess and awarded her the amount paid to the veterinarian. Shampooch appealed.
