Facts
Minimed (defendant) hired a pest company to spray for fleas in its building. The next day, Irma Hernandez, a Minimed employee, left work feeling ill from the chemicals and smell of the spray. On her drive home she was dizzy and lightheaded behind the wheel and she rear-ended Barbara Bussard (plaintiff). Bussard brought a negligence suit against Hernandez and Minimed, alleging that Hernandez was within the scope of her employment when she was driving home. Minimed filed for summary judgment and it was granted by the trial court. Bussard appealed.
