Facts
Byrd (plaintiff) faced criminal charges after he contracted to build a laundry room for Graddy, was paid $800, but never did the work. Byrd was informed that the state (defendant) would consider dismissing the criminal charge if Byrd reached a civil settlement with Graddy through mediation. Byrd agreed to the mediation request. Byrd and Graddy reached a civil settlement that required Byrd to pay $800 to Graddy in multiple payments. However, Byrd failed to make the required payments. Byrd was indicted. During the trial, the state introduced into evidence statements that Byrd had made during the mediation. Byrd was found guilty and convicted. Byrd appealed on the ground that the trial court erred in admitting into evidence statements Byrd had made during the mediation.
