Facts
The Fish and Game Commission of California (Fish and Game) seized a purse net from C.J. Hendry Co. (Hendry) (defendant) because the net was unlawfully used for fishing in California’s navigable waters. California sued in state court for forfeiture of the net. The state court ordered that the net be forfeited and sold or destroyed, and the California Supreme Court affirmed. Hendry appealed to the United States Supreme Court, which granted certiorari. Hendry claimed that California courts did not have jurisdiction over the case because federal courts had exclusive jurisdiction under the laws of admiralty.
