Facts
The plaintiff, a general contractor, solicited bids for the installation of steel at a construction site. The defendant submitted a bid and then verbally stated to the plaintiff that it could perform the work at that price. The plaintiff submitted its master bid based on this bid and verbal promise. The defendant turned out to be unable to perform the work at the price of its bid. The plaintiff sued the defendant for breach of contract. The plaintiff based the suit exclusively on the doctrine of promissory estoppel, an equitable doctrine. The defendant requested a jury trial. The trial court empaneled an advisory jury but denied the defendant’s request for a jury trial. The court found in favor of the plaintiff. The defendant appealed.
