Facts
Cable News Network, Inc. (CNN) (plaintiff) possessed tapes of communications between a criminal defendant, Manuel Noriega (defendant), and his attorney. The district court enjoined CNN from broadcasting those tapes. The restraining order did not include any analysis about whether suppressing the broadcast was needed to ensure Noriega received a fair trial. The district court found it unnecessary to make that finding before the court could review the tapes, which CNN had yet to turn over. The court of appeals affirmed the district court. CNN filed a petition for a writ of certiorari and an application to stay the restraining orders issued by the United States District Court for the Southern District of Florida.
