Facts
Dean Cabot (plaintiff) purchased land based on the seller, Thomas Christie (defendant) representing that the land was 130 acres. Cabot later discovered that the land was only 117 acres. Cabot brought suit against Christie. Christie stated that he did not know that the land was not 130 acres but that he had believed that it was. The trial court found in favor of Cabot. Christie appealed.
