Facts
William Cahill (plaintiff) leased a mill on Hennepin Island. William Eastman (defendant) constructed a tunnel going under the island. One day, water from the river seeped into the tunnel, causing damage to Cahill’s mill. Cahill brought suit against Eastman for the damage done to his mill from the construction of the tunnel. The trial court found for Cahill, and Eastman appealed the trial court’s denial of his motion for a new trial, arguing that Cahill needed to show Eastman was negligent in the construction of the tunnel.
