Facts
Michael Cain joined two friends on a night walk along the Newport Cliff Walk at around 2:00 a.m. The Newport Cliff Walk officially closed from 9:00 p.m. until 6:00 a.m. Cain stepped from the paved path and fell off the cliff, resulting in his death. William and Mary Cain (plaintiffs) filed a wrongful-death action on Michael’s behalf against the State of Rhode Island, the City of Newport, and Salve Regina University (defendants), claiming that they failed to maintain and repair the land. The trial court granted summary judgment in favor of the State of Rhode Island, the City of Newport, and Salve Regina University. William and Mary appealed.
