Facts
John Cain (plaintiff) sued Wal-Mart Stores, Inc. (defendant) after a 50-pound bag of dog food fell on him from an eight-foot-high stack, causing injury. Cain served discovery requests asking for information about the incident and Wal-Mart’s investigation of it, Wal-Mart’s policies or procedures, and other similar claims. More specifically, Cain requested the names of employees working in the store at the time, photographs or videos of the dog food stacks for the entire year, all merchandise-stacking policies or procedures, and any other stacking incident claims. Wal-Mart objected on multiple grounds and provided only partial answers. Cain moved to compel responses.
