Facts
During the course of the marriage between Margaret Callaway (plaintiff) and Danny Callaway (defendant), Margaret’s mother gave the couple a residential lot, on which the couple built their house, as well as a racing car, which both spouses used recreationally and helped maintain. Margaret subsequently filed for and was granted a divorce. Both Margaret and Danny appealed various aspects of the trial court’s property-settlement order to the Kentucky Court of Appeals. As to most of that order, the appellate court found no clear error and affirmed the trial court’s judgment. The appellate court then turned to the trial court’s classification of the residential lot and racing car as nonmarital assets excluded from the equitable distribution of the Callaways’ marital property.
