Facts
Vince Camastro (plaintiff) disagreed with a decision made by the West Virginia Alcohol Beverage Control Commission (the commission) (defendant) about his business. In response to the commission’s decision, Camastro, acting pro se, filed a civil suit against the commission and other defendants. One of the named defendants was deceased, and another named defendant was a former mayor of Wheeling, West Virginia who had been out of office for several years. Camastro had previously filed 13 separate lawsuits against the commission, each of which raised similar or identical claims and issues. Due to his harassing and vexatious litigation, Camastro had received a monetary sanction and had been subject to a narrowly tailored pre-filing injunction, neither of which stopped him from filing lawsuits. The commission requested that the court again sanction Camastro, but the court instead ordered Camastro to show cause as to why he should not be enjoined from filing additional related lawsuits. After holding a hearing on the matter, the court issued its decision.
