Facts
Joao Camejo was a Brazilian citizen and resident who worked as a commercial diver in undersea mineral exploration in Brazil for a Brazilian company, Superpesa Transportes Maritimos, Ltd. (defendant). Joao was killed in a diving accident in Brazilian waters while performing work for the Brazilian national oil company (defendant). Shirlei Camejo (plaintiff) was Joao’s widow and was also a resident of Brazil. Shirlei brought a claim for Joao’s wrongful death against numerous defendants in Texas state court under the Jones Act and general maritime law. The case was removed to federal district court. The district court dismissed the Jones Act claim as precluded under the statute and dismissed the general maritime claims under forum non conveniens. Shirlei failed to present any evidence disputing the evidence given in support of dismissing the claims for forum non conveniens.
