Facts
Canada (defendant) formed a state trading enterprise called the Canadian Wheat Board (CWB). Under Canadian law, the CWB had the exclusive right to purchase and sell Western Canadian wheat for export and domestic human consumption, the right to set the initial price payable for such wheat, and the right to guarantee payment to producers of such wheat. The United States (plaintiff) challenged this regime and asserted that it violated the General Agreement on Tariffs and Trade provisions relating to state trading enterprises.
